Terms of Service

1. Acceptance

By creating an account or using yondervast.ai (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

Yondervast is an end-to-end creative production environment that provides brief, strategy, asset, generation, gallery, and delivery tooling, integrating with third-party model providers (including but not limited to OpenAI, Anthropic, Google, ElevenLabs, and fal.ai). Features are subject to change, deprecation, and beta status.

3. Accounts

You are responsible for safeguarding your credentials and for all activity under your account. Notify us at security@yondervast.ai of any unauthorised access. Enterprise accounts may enforce SSO, MFA, role- based access, and seat allocation through their administrator.

4. Plans, Credits, Billing

• Credit-based consumption applies to generations. Credit costs are published in-app and can change with notice.
• Subscriptions auto-renew until cancelled. Cancellation takes effect at the end of the current billing period.
• Refunds are at our discretion and generally not provided for credits already consumed.

5. Content & Intellectual Property

You retain ownership of the prompts, references, briefs, and other inputs you submit ("Your Content"). You grant us a worldwide, non-exclusive licence to host, process, and display Your Content solely to operate the Service. We do not train shared third-party foundation models on Your Content. Outputs generated through the Service are yours to use, subject to the terms of the underlying model providers and applicable law.

6. Acceptable Use

Your use of the Service is also bound by our Acceptable Use Policy. Violations may result in suspension or termination without refund.

7. Third-Party Models

The Service relies on third-party model providers. Their terms apply to outputs they generate. We are not responsible for downtime, content moderation outcomes, or output quality of upstream models.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will fit a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Yondervast LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability for direct damages will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms, with or without notice. Sections that by their nature should survive termination (IP, liability, disclaimers) will survive.

11. Governing Law

These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of London, United Kingdom, unless otherwise required by mandatory consumer protection law.

12. Changes

We may update these terms. Material changes will be announced at least 30 days in advance via in-app notice or email. Continued use constitutes acceptance.
